The federal government has proposed a $103,265 fee for each new H-1B worker among the roughly 85,000 cap-subject visas issued each year, a draft Department of Homeland Security rule that has drawn fierce pushback from firms that rely on the program and from Indian media covering the change. DHS says the fee would fund adjudication and could make employers less likely to hire an H-1B worker over a qualified American unless the need is legitimate.
The draft exempts many nonprofit research organizations, government research bodies, and educational institutions from the fee. Kevin Lynn of U.S. Tech Workers called the move “a brilliant and bold stroke by DHS” to defend American graduates. The proposal was posted for public comment and, unless blocked in court, could take effect after a second rulemaking later in the year.
